Welcome to PacePilot
Before you begin your personal running journey, please take the time to carefully read these terms and conditions. They are important because they govern the relationship between you and Pace Pilot AS – and thereby affect your legal rights and obligations.
Privacy Policy
1. Introduction
This privacy policy explains how Pace Pilot processes your personal data when you use our training app. By using our app, you accept the terms of this privacy policy. Pace Pilot is the data controller for all processing of your personal data where we determine the purposes of the processing and the means we use for that processing.
2. What information we collect
We collect the following types of information about you:
- Personal information: Name, gender, year of birth, email address, phone number (Vipps), and payment information (third party: Stripe).
- Training data: Training history, performance, GPS data, and other training-related information obtained from the user, Strava, Polar, Suunto, or Garmin.
- Health data: Heart rate data obtained from Strava, Polar, Suunto, or Garmin.
- Health data: Sleep, HRV, stress, and VO2Max from Garmin and Apple after explicit consent from the user as part of approving sharing with PacePilot via Garmin’s and Apple’s services.
- Technical information: IP addresses
3. How we collect information
We collect information in various ways, including:
- Directly from you when you register, pay for the service, or use the app.
- Through connections to third-party platforms such as Strava, which you voluntarily connect to our app.
- Through the AI chatbot feature, which you voluntarily interact with.
4. How we use the information
The information we collect about you is used to:
- Provide and further develop our services.
- Personalize the user experience based on your training habits.
- Develop and deliver tailored running training programs using artificial intelligence (AI) based on your own training data, heart rate measurements, and AI chatbot conversations.
- Manage your subscription and payment information.
- Communicate with you about updates and other relevant information.
5. Sharing of information
We do not share your personal information with third parties, except:
- When necessary to deliver the service.
- When we have your explicit permission.
- When required by law.
We require everyone with whom we share your personal data to secure your data in accordance with the requirements of the GDPR. We enter into data processing agreements with all parties that process data on our behalf where required.

6. Security
We take security and your privacy seriously and use appropriate technical and organizational measures to protect against unauthorized access, alteration, disclosure, or destruction.
7. Your rights
You have a number of rights regarding the processing of your personal data. These rights include:
- Access: You have the right to request access to the personal data we hold about you.
- Rectification: You have the right to request correction of inaccurate or incomplete personal data.
- Erasure: You have the right to request deletion of your personal data. This does not apply if there are lawful grounds for continued processing.
- Restriction of processing: In certain cases, you have the right to request that we restrict the processing of your personal data.
- Data portability: You have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format, and to transfer that data to another controller where technically feasible. This applies only to data you have provided to us that is processed automatically and based on your consent or to fulfill a contract.
- Objection: You have the right to object to our processing of your personal data when processing is based on our tasks or a balancing of interests.
- Automated decisions: You have the right not to be subject to a decision based solely on automated processing, including profiling, if it has legal consequences for you or significantly affects you. This does not apply if the decision is necessary to enter into or perform a contract between you and us, is based on your consent, or is otherwise permitted by law.
- Withdrawal of consent: If processing of your personal data is based on your consent, you have the right to withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing based on consent before withdrawal.

We reserve the right to update this privacy policy as needed. Any changes will be published on our website, and you will be informed via email or other appropriate channels.

10. Use of email address for marketing
10.1 Purpose
We would like to keep you updated about our services, news, offers, and activities. If you consent to this, we will use your email address to:
- Send newsletters, promotional offers, and other information about our products and services.
- Create custom audiences on social media and other advertising platforms so we can reach you and similar users with relevant, targeted advertising.
10.2 Legal basis
The right to send you marketing communications by email requires consent, unless otherwise permitted under the Marketing Control Act (for example, “soft opt-in” if you are already a customer and the legal conditions are met). By checking a box or otherwise explicitly giving consent when you register, you confirm that we may contact you electronically for marketing purposes.
If you do not wish to receive marketing, you may choose not to give consent. You may withdraw any consent you have given at any time.
10.3 What data is processed?
- Email address: Used to send marketing communications, and possibly uploaded to social media (e.g. Facebook, LinkedIn, Instagram) for targeted advertising.
- Usage data: In some cases we may also use aggregated analyses or pseudonymized data from use of our services to evaluate advertising effectiveness or create more relevant ads.
10.4 Sharing with third parties
When we use your email address to create audiences, it is normally uploaded in encrypted (hashed) form to social media (e.g. Meta/Facebook) or advertising platforms. This email address will only be used to match you on the platform to show relevant advertising from us, and is then deleted/de-identified in accordance with the platform’s procedures.
We do not share your email address or other personal data with third parties for their own purposes unless otherwise stated in this privacy policy, or you have given specific consent.
10.5 How long do we store your data?
The data is retained for as long as you have an active relationship with us (subscription/customer/user) or until you withdraw consent. Upon withdrawal of consent, we will delete or anonymize your email address for marketing purposes, unless we have another lawful basis for continued retention.
10.6 Opt-out and withdrawal of consent
- You may unsubscribe from newsletters/marketing at any time by clicking the unsubscribe link at the bottom of emails you receive from us, or by contacting us directly.
- You may object to processing of your personal data for direct marketing under GDPR Article 21.
- If you have consented to receive marketing, this consent may be withdrawn at any time by contacting us at post@pacepilot.no. Withdrawal does not affect the lawfulness of processing that took place before consent was withdrawn.

By downloading and using our training app, you confirm that you have read and understood this privacy policy, and that you consent to our processing of your personal data in accordance with the terms described here.
Terms
1. About these terms
These terms (the “Terms”) apply to the use of the services offered by Pace Pilot AS (hereinafter “PacePilot”, “we”, “our”, or “us”). PacePilot delivers tailored running programs and related content (the “Content”) via the “PacePilot” app (the “Service”). The Service includes, among other things, personalized training plans, a dynamic AI coach, and may from time to time also include other digital content.
To use the Service, you must have an active PacePilot account. By creating an account and/or using the Service, you enter into a legally binding agreement with PacePilot and accept the Terms as applicable at any given time. The latest version of the Terms is always available at www.pacepilot.no. We process personal data in accordance with our privacy policy.
If you do not accept the Terms, you may not use the Service or access the Content we provide.

2. Age limit and account eligibility
2.1. To enter into this agreement and gain access to the Service, you must:
- be at least eighteen (18) years old or have the necessary legal authority/authorization under applicable law
- be resident in Norway (or another country where the Service is available)
- provide accurate personal data where requested
- register a valid payment method
2.2. You are responsible for ensuring that the information you provide is correct and up to date at all times.
3. Subscriptions from PacePilot
3.1. Types of subscription
Pace Pilot offers various subscriptions with different commitment periods (the “Subscription”). Our standard subscriptions have a monthly price ranging from NOK 99 to NOK 149 (subject to change). Certain promotional offers may differ in price for a limited period. Which subscriptions are available to you at any given time is shown on our website and/or in the “PacePilot” app.
3.2. Purchasing a subscription
You can purchase a Subscription directly from us via our website or app. Available purchase options may vary depending on, among other things, device type. The content and functionality of the Subscription may vary over time, for example if we change or improve the Service, or to meet legal requirements. If a change has a negative effect on your Subscription, you will be notified, and you may then cancel the Subscription before the change takes effect.
3.3. Switching between subscription types
If you wish to switch to a different Subscription, you can do so by contacting us or by adjusting the subscription under account settings at www.pacepilot.no or in the app. If you switch Subscription before the end of the current billing period, any price adjustments may take effect immediately or at the next billing, depending on what has been agreed.
3.4. Multiple users / households
Pace Pilot currently primarily offers Subscriptions for individuals, but we may in the future launch solutions for multiple users. Information about any family or multi-user solutions will then be available on our website. If such a Subscription becomes available, the person who pays for the Subscription (administrator) will be able to invite others in the household to use the Service.
4. Trial periods and promotional offers
4.1. Trial periods
In some cases we may offer a free or discounted trial period (the “Trial Period”) for new users so that you can try the Service. As a general rule, each person may only use one Trial Period. PacePilot decides at its sole discretion whether you are eligible for a Trial Period. If we discover abuse (e.g. you create multiple accounts with different email addresses), we reserve the right to terminate or limit access to the Trial Period.
4.2. Promotional offers
In addition to Trial Periods, we may offer other temporary promotions. Unless otherwise specified, promotional offers apply only to new customers. You will be charged the regular price when the promotional period expires, unless you cancel the Subscription before the promotional period ends.
5. Fees and payment
5.1. Price
Current prices for your Subscription are shown at www.pacepilot.no and/or in the app. Our prices may change over time, for example due to inflation, expansions of the Service, or increased costs related to rights or technical operations. If a price change affects you, you will be notified at least 30 days in advance so that you have time to cancel the Subscription before the price change takes effect.
5.2. Billing period
You are charged in advance for each billing period (usually monthly) from the purchase date or from when any free Trial Period expires. If you change Subscription, the new price will apply from the next billing date, unless otherwise agreed.
5.3. Payment methods
You can update your payment method under “My account” at www.pacepilot.no. PacePilot may at any time reject or block certain credit cards or payment methods for various reasons. If you have purchased a Subscription via a third party (e.g. an app store), the third party’s terms for payment apply.
5.4. Failed payment
If payment cannot be completed (for example due to an expired card), your access to the Service may be temporarily blocked until you update your payment information.
6. Right of withdrawal, cancellation, and notice period
6.1. Right of withdrawal
As a consumer, you have a 14-day right of withdrawal under the Norwegian Cancellation Act. The withdrawal period runs from the purchase date. If you wish to exercise the right of withdrawal, you must clearly notify us within 14 days. You may use the withdrawal form at the bottom of these Terms or send an email to post@pacepilot.no. If you exercise the right of withdrawal, the Subscription ends immediately, and we will refund your payment without undue delay. We may, however, deduct an amount corresponding to your actual use of the Service during the withdrawal period.
6.2. Cancelling a subscription
You may cancel the Subscription at any time through account settings at www.pacepilot.no or in the PacePilot app. If you cancel the Subscription, it expires at the end of the current billing period. If you have an active Trial Period and cancel before it expires, access will stop immediately.
6.3. Automatic renewal
If you do not actively cancel the Subscription before the renewal date, the Subscription is automatically renewed for one new billing period. You agree that we charge the subscription fee via your chosen payment method on the renewal date.
6.4. Termination by PacePilot
PacePilot reserves the right to terminate your Subscription if we reasonably believe that the terms are not being complied with, or if you do not reside in a country where the Service is offered.
7. Use of the Service
7.1. Access to the Service
PacePilot delivers a personal digital service that gives you access to training programs, AI-based coaching, analyses, and other relevant content directly in the app. You receive a limited, revocable, non-exclusive, non-transferable right to use the Service for your private purposes, in accordance with the Terms.
7.2. Technical requirements
To use the Service you need a compatible device (for example a smartphone) with internet access. You must also have downloaded the PacePilot app. From time to time we may ask you to upgrade the app to maintain security and improve the user experience.
7.3. Fair use
You undertake to use the Service in accordance with applicable laws and good practice. You shall not:
- A) use the Service in a way that is illegal, fraudulent, or harmful
- B) attempt to disrupt, circumvent, or create problems for the Service’s infrastructure
- C) share username and password with others or otherwise give unauthorized persons access to the Service
- D) copy, redistribute, sell, lease, or otherwise attempt to commercialize the Content without our written consent
- E) abuse promotional and/or discount schemes (e.g. exploit Trial Periods multiple times)
Use in breach of this provision is considered a material breach and may result in immediate closure of your account and/or legal action.
7.4. User-generated content
If you share user-generated content in the Service (e.g. discussions with our AI coach or posts on social media related to Pace Pilot), you are responsible for ensuring that this does not infringe third-party rights or is otherwise offensive, harassing, or illegal. PacePilot reserves the right to remove such content.
8. Changes to the Service and intellectual property rights
8.1. Change or removal of content
The Content in the Service may be updated, changed, or removed on an ongoing basis, for example to improve the user experience, comply with legal requirements, or take into account third-party rights. Such changes do not in principle give rise to compensation for you as a user, unless otherwise specifically agreed or required by mandatory law.
8.2. Copyright
All content in the Service – including text, video, audio, images, design, source code, or other material – belongs to PacePilot or our licensors, and is protected by copyright and other intellectual property rights. You have no right to copy, distribute, or otherwise exploit the content without prior written consent.
9. Suspension and termination by us
9.1. Suspension of service
We may, without notice, temporarily suspend your access to the Service if you materially breach the Terms, or in the event of security breaches, risk of fraud, suspected illegal activity, and the like.
9.2. Termination by us
We may terminate the Agreement with immediate effect if you breach the Terms or applicable laws and regulations. Termination means that you lose access to the Service without entitlement to a refund, unless mandatory law provides otherwise.
10. Limitation of liability
10.1. Availability
PacePilot strives to make the Service available at all times, but cannot guarantee that the Service is free from errors or interruptions. Planned maintenance, technical errors, or circumstances beyond our control may cause downtime.
10.2. Limitation of liability
If you are dissatisfied with the Service or the Content, your sole remedy is to cancel the Subscription. PacePilot is not liable for indirect loss, and our financial liability is in all cases limited to the amount you have paid for the Service in the twelve (12) months preceding any claim, unless otherwise required by mandatory law.
10.3. Third-party links
The Service may contain links to third-party websites or services. PacePilot is not responsible for the content of these websites or services.
11. Privacy
How we process your personal data is described in our privacy policy, which you can find at www.pacepilot.no. By using the Service, you accept our collection, use, and sharing of your personal data in accordance with this policy.
12. Changes to the terms
12.1. Notice of changes
We reserve the right to change the Terms when necessary, e.g. due to changes in legislation or in the Service. If the changes are material and affect your rights or obligations, we will notify you at least 30 days before the new terms take effect. Continued use of the Service after the changes have taken effect is considered acceptance of the updated Terms.
13. Governing law and dispute resolution
13.1. Governing law
The Agreement is governed by and shall be interpreted in accordance with Norwegian law, unless otherwise required by mandatory law in the country where you have your habitual residence.
13.2. Dispute resolution
If you are dissatisfied with the Service, you may contact us at post@pacepilot.no. Complaints that are not resolved amicably may be brought before the Norwegian Consumer Authority if you are a consumer. Regardless of this, disputes may also be brought before the ordinary courts, with Sarpsborg District Court as the venue, unless otherwise required by mandatory law.
